The original law (Decree 92/2009) covering Holiday rental licences in the Valencian Community was modified in January 2015, making it now compulsory for all types of tourist accommodation, including Viviendas Turisticas, to register their property with the Registro de Empresas, Establecimientos y Profesiones Turísticas (The Register of Tourist Businesses, Establishments and Professionals).

The Comunidad Valenciana has adopted different regulations on tourist accommodations, specially decree 92/2009 on “viviendas turísticas”.
According to article 2 of Decree 92/2009, “viviendas turísticas” (tourist accommodations) are defined as “los inmuebles, cualquiera que sea su tipología, cuyo uso se ceda mediante precio, con habitualidad, en condiciones de inmediata disponibilidad, y con fines turísticos, vacacionales o de ocio”. A tourist accommodation will be considered to be rented “con habitualidad” (on a regular basis) if it is let by “empresas gestoras” or by Hosts to Guests through tourist marketing channels.
Article 4 of Decree 92/2009, “empresas gestoras de viviendas turísticas” are defined as the legal or natural persons “cuya actividad profesional, principal o no, consista en la cesión a título oneroso del uso y disfrute de, al menos, 5 viviendas turísticas, con independencia de su ubicación o no en un mismo edificio o complejo y de cuál sea el título que les habilite para hacerlo.”
For viviendas turísticas : every “viviendas turísticas” must be registered, whether they are managed directly by owners or by “empresas gestoras”. You can complete the registration online or in-person at the “Servicio Territorial de Turismo” of the province of location. For empresas gestoras : If an Owner is renting more than 4 viviendas turisticas, he/she must register as “empresa gestora”. The registration can be completed online or in-person, to the “Servicio Territorial de Turismo” of the province in which are located most of the “viviendas turísticas” managed by the “empresa”. Classification. 3 categories of “viviendas turísticas” : “superior”, “primera” and “estándar”. Anexo of the Decree 92/2009 lists the dimensions, installations, services and more for each category. We highly encourage our Hosts to refer to this Annex. Hosts must certify to which categories their accommodations belong at the time of registration. The category must be specified on your listing.
Services and prices : some services must be included in the price of the rent, like access to swimming pool or the provision of electricity and water. See capitulo V of Decree 92/2009.
All relevant laws : the rental must respect all city, Valencian and State laws. You can find a list of relevant laws on the official website of Generalitat Valenciana.
Under article 10 of the Decree 92/2009, the registration number of the “vivienda turística” must be entered on your misterb&b listing. To include registration numbers on your listing(s), go to “edit my listing” > “address” when you are connected on your misterb&b account.
All Guests are required to fill in a registration form (parte de entrada) provided by the Host, at the check-in. A copy of each filled-in registration form must be communicated to the Police for every Guest over 16 years old (it can be done online). The originals must be kept by the Hosts for 3 years.
